Act of the State Environmental Inspectorate on verification of compliance with environmental requirements

Holder of Document: One copy (with relevant attachments) is handed over to the manager (or a person authorized by him) of the business entity.  CA corresponding note is made on the last page of the copies of the inspection report with the signature of the person who received the inspection report, indicating the position, surname and initials, and as well as the date of receipt of the act. The second copy of the inspection report is kept by the State Inspectorate. In the case of the FME the document is typically available at the Department of Forest Management of the FME (Chief Forester). 
Signature required by:
On the last day of inspection, two copies are signed by the state inspectors who conducted the inspection, and all members of the commission (if the inspection was conducted by the commission), the manager or an authorized person of the business entity. If the business entity does not agree with the act, it signs the act with comments.  If the business entity refuses to sign the act, this is noted in the inspection act.

Purpose and content of document:
The State Environmental Inspectorate inspection report is a document that records the fact of the inspection of business entities. Report presents information about detected violations of the requirements of legislation in the field of environmental protection and its compliance. Inspection object - enterprises, production sites, equipment, installations, territories, etc. - which are associated with a harmful effect on the surrounding natural environment (including their placement, design, construction, reconstruction, and commissioning), objects of natural reserve fund. According to the Law "On the basic principles of state supervision (control) in the field of economic activity", planned inspections of state control bodies must take place according to a certain schedule. Depending on the number of criteria, the enterprise can be classified as an object with different potential for danger: insignificant risk; medium level of danger; high risk. Audits are scheduled every 5 years for the first group of enterprises, every 3 years for the second, and every 2 years for the last.  The list of issues subject to verification of compliance with the requirements of environmental legislation are contained in the unified form of the Act of Verification of Compliance.
Evidence limitations and weaknesses:
• Publicly available database at the inspections.gov.ua which is normally used to verify this inspection acts are not available during martial law in Ukraine.  • Some of the inspection's acts contain a lot of detailed information about minor violations of environmental law and require sufficient time to analyze it.
